Law student sues General Legal Council over exam scores

The student has sued the General Legal Council at a Human Rights Court

Gertrude Quayson, a law student at the UPSA Campus of the Ghana School of Law, has sued the General Legal Council.

She has filed a writ against the Council, seeking, among other things, a court order for the rescission of a decision by the Independent Examinations Committee which she says has resulted in repetition in the Part I of the law course.

Represented by Albert Quashigah of Sustineri Attorneys, Quayson is dissatisfied with the results of all her examination scripts released by the Independent Examination Committee.

She alleges that the Council failed to publish her results as expected and did not provide her with her raw scores, unlike other students.

According to the writ filed at the Human Rights Division of the High Court, Quayson scored below 50% in all her scripts except for her Alternative Dispute Resolution paper. She claims these grades do not reflect her diligent learning and performance during the exams.

Quayson applied to the Independent Examination Committee for a review of her scripts but has not disclosed whether she followed the Committee’s directive to apply for remarking and pay the associated fees.

The plaintiff argues that the application for a review of her scripts is the only recognized process for challenging examination results according to the Legal Profession (Professional and Post-Call Law Course) Regulations, 2018 (L.I 2355).

She, among other reliefs, seeks a declaration from the court that remarking is not the sole means of challenging examination results as well as an order for her application for a review to be honoured.

Quayson also seeks an early resolution of the matter as the decision by the Council and the Ghana School of Law has prevented her from undertaking her mandatory internship in Part II of the Professional Law Course, delaying her completion of the course.
